How was this being scrutinized from a legal point of view? In as far as the ongoing libel case filed by Rod Nazario, how's the moderators' role and the site admin going to handle such incidents where some postings did violate the site's disclaimer? Are you going to divulge poster's info?

At this point, we have not yet received the specifics of their charges so I don't know if the charges include postings from the forum. My guess is they probably could not find a solid legal basis based on the Philippine laws to file charges against the postings so I think the charges were for Winchell's and Pedro Fernandez's stories that were posted and linked from the site.

It looks like they're just harrassing the site Dong, they want to rattle our cage and they didn't like what they saw, instead of backing down and cower in fear, they saw war coming right at them from our devoted members.

I am not a lawyer but the waiver statement ("will not be held accountable..., etc...") in your disclaimer has its teeth I guess against the aggrieved party. Hope, it can be likened as somebody renting your house (this site) and the owner of the house (you) is not responsible for any illegal activities (used a shabu lab :biglaugh: ) happening at the time of the occupancy. This is where an agreement or contract comes in between the owner and the occupant. As in this case, we (poster) and you have the site disclaimer.

Right, the medium (http://www.mannypacquiao.ph) was used by some other writers. Manny's conditioning coach could file libel case also against Rita Sharp or RN (?) who said Justin did nothing to Manny but wrecked his tummy instead.

Anyway, it's something we poster have to be careful and I appreciate much of all moderators effort especially PSO_Jr's :captain: for keeping the site organized.

copy loud and clear. Pacland is well intended for free expression of its members and with a sound protections against possible abuse.
