Robredo won’t succeed Duterte under House panel’s draft federal charter

"In case a vacancy arises by reason of removal, resignation, permanent incapacity or death of the incumbent President, the incumbent Senate President shall as act as President until a President shall have been chosen and qualified," the section added.

Article XVII refers to "Transitory Provisions," which lay out the structure and status of the government during the transition period until the new federal government is fully operational.

Bongbong poll protest

In a phone interview with reporters, House panel chair Vicente Veloso said the decision to have the incumbent Senate President succeed Duterte is mainly due to defeated vice presidential candidate Ferdinand "Bongbong" Marcos' ongoing electoral protest against Robredo.

"Remember that this is good only for three years at most; transitory provision ito," he said, referring to the next presidential elections in May 2022.

He then imagined a scenario where the vice presidency could swing from Robredo to Marcos and back again, depending on the recount result and the motions for reconsideration that might arise from it.

"Because of this problem, since [sa] batas natin ang next sa line ng succession to the President ay Vice President at after the VP ang Senate President, may nag-propose na idiretso na lang sa Senate president para walang instability tayo in the occupancy sa napakaimportanteng position ng presidente," Veloso said.

"Tsaka it is not an only ongoing protest, the dispute involves a very slim margin. 'Yun lang naman ang punto ng proponent," he added.

Duterte has openly declared his aversion to the idea of Robredo—who leads the opposition—taking over from him, even saying he would prefer Marcos, who holds no elected position, as his successor.

The draft federal charter's resolution has been endorsed to the chamber's plenary after it has been approved by the panel.

Aside from this provision, the panel's draft federal charter also states that the terms of the incumbent President and Vice President, which will end on June 30, 2022, will not be extended.

Duterte is likewise prohibited to run for President in the 2022 elections under the draft federal charter.

The draft charter also lifts term limits for lawmakers.

Under the 1987 Constitution, the public should be informed of the President's state of health in case of serious illness. The 1987 Charter also provides that the members of the Cabinet in charge of national security and foreign relations, as well as the chief of staff of the Armed Forces of the Philippines, “shall not be denied access to the President during such illness.”

In addition, the 1987 Constitution states that the Vice President shall become the President to serve the unexpired term in case of the President's death, permanent disability, removal from office, or resignation.

Macalintal then slammed the President’s allies for making it appear that he is sick with such “political calisthenics” on the topic of transition instead of wishing him well.

“Sa kabila ng pahayag ng Malacañang na mas malakas pa sa kalabaw ang Pangulo, bakit ang mga kaalyado niya ang parang nagpapahiwatig na ang Pangulong Duterte ay may sakit na maaaring makaapekto sa kanyang panunungkulan?” Macalintal said.

“Kung siya ay may sakit, hindi succession ang dapat pag-usapan kundi dalangin para sa kanyang kalusugan. Kung may sakit ba ang inyong tatay ay pag-uusapan na ba agad kung sino ang magmamana at magkano ang mamanahin?” Macalintal added.

The veteran election lawyer also said that such proposal won’t move an inch anyway because the House and Senate have yet to decide if they are going to vote jointly or separately on the proposed draft constitution that will pave the way for the institution of federal government.

The 1987 Charter does not explicitly state whether the House and the Senate, as a Constituent Assembly, should vote jointly or separately on a proposed constitution.

MANILA - President Rodrigo Duterte does not have cancer, the acting interior minister said on Tuesday, after the firebrand leader underwent tests in a private hospital.

The public has been clamoring for information about Duterte's health after the 73-year-old missed two official events last week.

"He disclosed to us that the result of the test was negative, the one where they took samples from his intestines," Eduardo Ano told reporters in an event posted on Facebook live by local news agencies.

Jesse never introduced VP Leni to us. He kept his personal life separate from his life in government. I only met her during the inauguration of a Jesse Robredo Center months after his passing. I began crying even before I began my speech. In contrast, she was a personification of calmness and dignity. She spoke about his leadership and love of the poor. Her heart must be broken but no tears fell. She was in full control of her emotions.

The second time I met her was when I introduced her to a group of friends. She was a reluctant candidate and was pressured to be in politics to preserve unity in Naga. Since we knew little about her background, she introduced us to her work with women, farmers, and the marginalized, in her capacity as a lawyer and an economist. She spoke from her heart which convinced us that she will lead with sincerity and truthfulness. After all, she had the best mentor who led by example. VP Leni always says, that her daughters and she, had front seats in witnessing the governance of Jesse.

Fast forward to her election as Vice President. I watched her from afar as she bore all the criticisms and vilification campaigns with humility and grace. She rose above brickbats and proved that she would not be derailed from the center of her agenda– giving hope and reaching out to those in the periphery. Since her office has scant resources, she mobilized the private sector and ordinary citizens in helping poor communities.

It was therefore with awe when I saw a different Leni when I was invited to join one of her meetings. She asked pointed questions, demonstrated her knowledge on national issues, and led the discussion with logic and depth. She was articulate, and decisive on matters that generated conflicting opinions and recommendations. I was convinced that she knew a demagogue from those who meant well. I think that she was always those except that we hardly noticed. It was always Jesse at the center stage. When I bade goodbye, I called her “Ma’am.” She was no longer Jesse’s wife. She is the Vice President of the land.

Two weeks ago, we witnessed once more the kind of leader that she is. She was the guest speaker in the 12th Washington SyCip National Education Summit at PICC. Nobody noticed her as she quietly queued up in the Ladies room— no fuss, no demand to be ahead of the line. Unavoidably, she was accompanied by the PSG. She was apologetic that she had company and brought packed lunch with her so as not to unduly burden the organizers. How very Jesse, how very VP Leni.

Everybody stayed glued to his and her seat as she emphasized that a true leader does not evoke fear but respect. And that a true leader can only be successful if she or he inspires the people to be better than he or she is. This is the only way for programs to be sustainable.
The governance of VP Leni is humble. She does not expect any entitlement. She is still embarrassed by the special attention that she gets.

Her governance is righteous. The bills she authored were those that empowered citizens, prevented discrimination, promoted transparency and bottom-up programs.

She believes that greatness can only come if you serve others. Very early on, she walked with the Sumilao farmers to fight for their 144-hectare ancestral land. She used her legal expertise to help them fight for their rights. She worked with women and the poor to help them realize that they are special.

She has spent time with over 100 communities, most of them in the hinterlands, to help improve their lives . She carries no gifts but with the help of organizations, she links products with markets, and broadens access to education, health, and livelihood opportunities. Her work is not covered by media and is hardly known. But she carries on with unyielding passion.
Courage, humility, competence, righteousness and love for the poor–these are what true leaders are made of.
