NBI nabs consignee of P6.4 billion shabu shipment from China

National Bureau of Investigation (NBI) operatives arrested on Friday, the consignee of the P6.4 billion shabu shipment which was smuggled from China.

In a text message to reporters, NBI Public Information Officer Nick Suarez said suspect Eirene Mae Tatad will be brought to the NBI Headquarters in Manila following her arrest in Iloilo.

Tatad, owner of EMT Trading, was ordered arrested by the Manila Regional Trial Court (RTC) Branch 46 for violation of Republic Act 9165 or the Comprehensive Dangerous Drugs Act of 2002 for importation of dangerous drugs.

Aside from Tatad, the court also ordered the arrests of Customs fixer Mark Taguba, who already surrendered to the NBI, Li Guang Feng alias Manny Li, Dong Yi Shen Xi alias Kenneth Dong, Teejan Marcellana, Chen I-Min, Jhu Ming Jhyun, and Chen Rong Juan.

The court ordered the arrests of the suspects after finding probable cause in the criminal charges filed by the Department of Justice over the shabu smuggling fiasco. /muf

Valenzuela court junks drug case vs. suspects in ₱6.4B shabu smuggling

Metro Manila (CNN Philippines, May 3) — A court in Valenzuela City junked drug charges on Thursday against nine suspects in the smuggling of ₱6.4 billion worth of shabu from China in May 2017. The suspects, however, are not yet off the hook as they face another case before a Manila court.

It is the second time that a Valenzuela Regional Trial Court (RTC) has dismissed charges against the same suspects. The Valenzuela RTC Branch 284 on April 23 banished the transportation and delivery of drugs case filed by the Department of Justice (DOJ) in January, after an original importation case was junked weeks earlier by the city's RTC Branch 171.

The dismissed charges were those filed against against Richard Tan, owner of the Hong Fei Logistics warehouse in Valenzuela City where the drug shipment was found; fixer Mark Taguba II; alleged middlemen Manny Li and Kenneth Dong; import company owner Eirene May Tatad; Customs broker Teejay Marcellana; and Taiwanese businessmen Chen I-Min, Jhu Ming Jhun, and Chen Rong Huan.

The decision, penned by Presiding Judge Arthur Melicor, granted the motions filed by suspects Tan, Taguba and Marcellana to dismiss the complaint on the grounds of forum shopping. Forum shopping happens when a case is filed in two separate courts in hopes that one of them will rule favorably.

"Filing a case for importation in Manila after the court in Valenzuela City has dismissed an earlier case for importation for lack of jurisdiction, and then filing another case, this time for transportation, before this court involving the same accused and based on the same facts, issues and arguments, clearly bears the hallmarks of forum shopping," Melicor's decision read.

Melicor in his resolution said the prosecutors divided the criminal information — importation and delivery — between two separate courts, were part of a "common ultimate design" eventually ending in the deposit of the shabu shipment in Hong Fei's warehouse.

"From the point of view of the conspiracy to import the subject shabu, it may be said that the transport and delivery to the Hong Fei warehouse was a mere part of a series of acts to execute their shared design to import shabu," the decision read.

Another importation of drugs case filed in November last year against the suspects is pending at the Manila Regional Trial Court.

The DOJ filed the charges against the nine suspects for allegedly conspiring to transport and deliver dangerous drugs under Sections 5 and 26 of the Comprehensive Dangerous Drugs Act of 2002.

The 604-kilogram shabu shipment is one of the biggest hauls of smuggled drugs in the country, and was subjected to a Senate inquiry.

The shipment passed through the Bureau of Customs as kitchenware on May 17, 2017. Nine days later, Customs officials found the bags of shabu in Tan's warehouse, hidden in five solid steel cylinders used in printing presses.

PDEA agents nab public school teacher, 3 others, for drug trafficking

A public school teacher and three others were arrested after yielding a total of P7-million worth of shabu during a buy-bust operation in the province of Maguindanao, the Philippine Drug Enforcement Agency (PDEA) said on Saturday.

Suspect Salama Diwa Talib was arrested in Awang, Datu Odin Sinsuat, Maguindanao by agents of PDEA, with the assistance of local authorities, on Friday, June 15.

According to the post-operation report, Talib was a public school teacher at Datu Unsay Elementary School in Maguindanao.

Aside from Talib, the other suspects arrested during the anti-drug operation were Saiden Adil Yusa, Mahmod Guiamalodin Dimudtang, and Naser Kamurindong Pasawilan. All of them were identified as cohorts of Talib in his alleged illegal drug activities.

Seized from the suspects was a pack of suspected shabu weighting 50 grams amounting to P340,000. It was the object of the sale during the PDEA’s buy-bust operation.

Also found from their possession were 950 grams of suspected shabu with street value of P6,460,000, four units of cellular phones, P1,000 bill used as a buy-bust money, and 119 cut pieces of photocopied P1,000 that was also used as a buy-bust money.

The suspects will face charges for violations of Republic Act 9165 otherwise known as Comprehensive Dangerous Drugs Act of 2002. /jpv

the case against Taguba and et al (in my opinion patsies and most likely unaware that the shipment contains drugs) were dismissed by the Valenzuela court because of "forum shopping". nagbabasa ba kayo? dati na yang balita na yan. and the case involves personalities that may not be involved with the drugs. but I agree with the contention that ignorance should not be an excuse also for them to be acquitted.

in the same way the BOC officials, especially former BOC head Nick Faeldon and BOC intelligence officer Neil Estrella. ang sa kaso na lang ni Neil Estrella, napaka basic na ginawa nya sa paglabag ng batas (obstruction of justice) by opening the cylinders WITHOUT a search warrant. i mean maski attorney patola tulad ni Nabas masasabing obstruction of justice na yan. mismong PDEA nagsabi nun. pati yung ginawa ni Faeldon na nakinig sa girlfriend nya who was not connected to any government agency, pero nagbibigay ng advise which turned out to be wrong.

for their actions, WALA silang kaso na nakuha, na dismiss pa. kasi lahat sila kaalyado ng current government. this case really proved to me na HOAX itong War on drugs. before I can't really say sa mga accusations ke Duterte kasi wala akong kasong nasundan. pero ito, the final nail in the coffin, confirms the accusation.

kaya to believe in War on drugs of the current administration, you must be some kind of retard to continue to believe in it. I say that not as an insult but as a matter of fact.

pero itong si Neil Estrella, ang ginawa nya by taking custody of the drugs, eh taga BOC naman sya, a mere Intelligence Officer, took it upon himself and spentg many hours painstakingly opening the cylinders. kung nanood kayo ng congress at senate investigation, tameme si Estrella dito. laht na palusot nya, supla. galit na galit ang PDEA on bakit ginalaw ng mga taga BOC ang mga droga!

klarong klaro, obstruction of justice na yan, tampering with evidence, wala pang search warrant. sus, sa dami pwedeng i-kaso, pero pagdating sa dulo.... ABSWELTO ng Duterte administration!!!
