Cebu’s top drug suspect, runner killed in gun battle

CEBU CITY - The top drug suspect in Cebu and his runner were killed during a police operation late Monday afternoon.

According to Provincial Drug Enforcement Unit Chief Police Captain Alejandro Batobalonos, drug suspects Gerly Luwage and Junel Lasam were killed during a gun battle while police were serving a warrant of arrest in Barangay Basak San Nicolas, Cebu City.

Batobalonos said Luwage is the number 1 high value target (HVT) in Cebu in relation to the illegal drug trade and was the right-hand man of Cebu’s alleged drug lord Steve Go who was killed inside Mandaue City Jail June last year.

Batobalonos added that after Go was killed, Luwage become the number 1 illegal drug trader in Cebu who can sell 15 kilos of shabu per transaction.

Palace offers P10-million bounty for ex-cop Acierto, DOJ chief confirms

MANILA (UPDATE) – Justice Secretary Menardo Guevarra confirmed Monday that Malacañang has put up a P10-million bounty for information that could lead to the arrest of dismissed cop Eduardo Acierto.

In a text message to reporters, Guevarra said: “P10m bounty confirmed.”

The justice chief however clarified he is “not privy [as] to where it will be sourced,” in response to queries as to where the reward money will come from.

Acierto has an arrest warrant issued against him by the Manila Regional Trial Court Branch 35 on April 12 on charges of illegal importation of dangerous drugs under sec. 4 of the Comprehensive Dangerous Drugs Act.

Also ordered arrested along with Acierto are former Philippine Drug Enforcement Agency (PDEA) deputy chief Ismael Fajardo, Jr., former Customs intelligence officer Jimmy Guban and 5 others behind VECABA Trading, the consignee of 2 unclaimed magnetic lifters in the Port of Manila where shabu was found.

The arrest warrants were in connection with the successive recovery of magnetic lifters in August last year – 2 were abandoned at the Port of Manila which contained 355 kilos of shabu worth P2.4 billion and 4 more in in an abandoned warehouse in General Mariano Alvarez, Cavite which PDEA believes contained 1.6 tons of shabu worth an estimated P11-billion.

The National Bureau of Investigation (NBI) had tagged Acierto, Fajardo and Guban as the core conspirators in the smuggling of illegal drugs in the country.

Guevarra noted that the P10-million amount is “certainly much larger than what the DOJ [Department of Justice] could offer,” citing the case of Peter Go Lim where the reward the DOJ offered is only P500,000.00.

Thus, he said, the DOJ will no longer offer any bounty for Acierto but will focus on his coddlers instead.

“As to Acierto’s coddlers, we’ll have them arrested wherever Acierto may be found hiding and brought to inquest immediately,” he said.

Guevarra earlier told ABS-CBN News that people who harbor or conceal an accused-at-large are liable for obstruction of justice. They may also face imprisonment of up to 20 years and a fine of up to P500,000 under section 4 of the Comprehensive Dangerous Drugs Act of 2002.

Guevarra had also ordered a probe into the leak of the DOJ’s indictment of Acierto and the 7 others, expressing concern that the leak might make it difficult for authorities to arrest 7 of the 8 accused who are still at large.

Of the 8 charged, only Guban was under the custody of the DOJ at the time the arrest warrants were issued. The DOJ has since terminated his coverage under the witness protection program and was subsequently arrested by the NBI.

Acierto had recently come out of hiding to accuse former Duterte economic adviser Michael Yang of involvement in the illegal drug trade. He also claimed the President himself ignored reports about Yang’s activities.

He said he was being set up and implicated in the magnetic lifters shabu shipment case after he sent a report to then Philippine National Police (PNP) Chief Ronald dela Rosa and PDEA chief Aaron Aquino detailing Yang’s alleged illicit activities.

Dela Rosa had admitted Acierto approached him once about Yang but dismissed his credibility. Aquino admitted seeing the report but said PDEA had a hard time validating the information.

‘Bodegero’ acquitted in P6.4-billion shabu case

MANILA, Philippines — The “bodegero” or warehouse caretaker in Valenzuela implicated in the importation of P6.4 billion worth of methamphetamine hydrochloride or shabu in 2017 has been acquitted by the Valenzuela regional trial court (RTC).

In a resolution dated March 18, Valenzuela RTC Judge Arthur Melicor granted Fidel Anoche Dee’s demurrer to evidence after ruling that the warehouse caretaker had no knowledge that the crates being delivered to him contained illegal drugs.

Dee’s legal woes are far from over. He is a co-accused in a related case before the Manila RTC, this time involving drug smuggling in violation of the Customs Modernization Act.

The judge’s resolution confirmed Dee’s defense that he was merely a fall guy of the Chinese businessmen and Customs fixer Mark Ruben Taguba, the principal players in the 602-kilo shabu shipment that landed at the Manila port and was delivered to a warehouse in Valenzuela before being seized by authorities in May 2017.

Of the principal players, only Taguba, his consignee Eirene Mae Tatad and middleman Kenneth Dong are detained to face charges. Hongfei Logistics owner Chen Julong and his four Chinese coaccused remain at large.

Dee was charged with illegal possession of 100 kilos of shabu that were subjected to controlled delivery.

Even though Dee’s name was written on short bond papers taped to the seized crates containing the shabu, he was not included in the import documents, former Bureau of Customs (BOC) intelligence chief Neil Anthony Estrella testified in court. Estrella resigned at the height of the controversy.

When the crates containing 100 kilos of shabu were sent under controlled delivery to Dee’s warehouse in Barangay Ugong, the operatives admitted to having Dee sign a document they said was a delivery receipt, but was actually a letter of authority from the BOC commissioner to allow an inspection.

When the crates arrived at the warehouse, Dee denied receiving them, even daring the officials to open them to prove that there was shabu inside, the court noted.

“There is absolutely no showing that Dee knew that what was being delivered to him were drugs, and that he willingly accepted the delivery. In truth, it was his mere contracted duty as paid warehouse caretaker or bodegero to accept the delivery of a shipment… Thus, it cannot be said that he had the intent to possess the said drugs,” the judge said.

The operatives also were not authorized by the BOC commissioner to conduct a controlled delivery, according to the judge.

“There was not even a pretense that a delivery was being made, because what the agents showed the accused was not a legitimate delivery receipt of the importer, but a letter of authority to inspect his warehouse… It would even appear that the men were there to inspect something that they themselves had brought with them,” the judge said.

Woman smuggles P.1-M shabu ?into Navotas jail

MANILA, Philippines — A woman was arrested as she tried to smuggle P100,000 worth of methamphetamine hydrochloride or shabu into the Navotas City Jail on Friday.

The shabu was found in the secret pocket of Avegail Umali’s shoulder bag as she went to the jail to visit her partner, detainee Reginal Jacobe, according to jail warden Chief Inspector Ricky Heart Pegalan.

Umali looked uneasy when authorities frisked her, Pegalan said. She grabbed her bag when authorities checked her belongings before discovering the shabu inside a hidden pocket, he added.

She will be charged with possession of illegal drugs. Pegalan said he has also ordered an investigation into the smuggling and sale of drugs in the city jail.

Navotas City Jail used to be the country’s most congested jail at 2,400 percent but the congestion rate was reduced to 730 percent with the opening of a jail annex last March.

The new jail annex, housed in the city’s former social welfare office, effectively reduced the present congestion rate of 2,413.16 percent to 737.8 percent.

Chinese, 3 others caught with P20-M shabu

MANILA, Philippines — A Chinese and three Filipinos were apprehended yesterday in a drug bust that yielded over P20 million worth of shabu in Valenzuela City.

Wu Lianlai was arrested along with Florencio Serdon, Sunbenny Marquez Jr. and Christopher de la Cruz by agents of the Philippine Drug Enforcement Agency (PDEA) in Barangay Maysan at around 12:30 p.m.

Police said they recovered at least three kilos of shabu worth P20.2 million from the suspects.

The suspects are being held by police on charges of trading and possession of illegal drugs.

In Caloocan City, three alleged members of a drug ring were nabbed in an anti-narcotics operation in Barangay 171, Bagumbong yesterday.

They were Crisanto Rueda, 45, of Marilao, Bulacan; Jeffrey Ilagan, 37, of Peasant View, Valenzuela, and Danilo Racho, 57.

Maj. Harold Aaron of the Police Community Precinct 6 said they confiscated sachets of shabu and a .45-caliber handgun from the suspects. – With Rey Galupo

Pipe installer nabbed with P2.8-million worth of illegal drugs

CEBU CITY, Philippines — A pipe installer landed behind bars after he was caught with 425 grams of suspected shabu valued at P2.8 million in a police operation in Barangay Mabolo on Sunday afternoon, May 19.

Marvin Saberon, 32, was arrested by operatives of the Drug Enforcement Unit (DEU) of the Cebu City Police Office (CCPO) in a buy-bust operation in Sitio Lahing-Lahing 2, Barangay Mabolo in Cebu City.

According to Police Lieutenant Colonel Carlito Apilat, City Intelligence Branch (CIB) chief and the team leader of the operation, Saberon is a newly identified drug personality in the area and has been placed under surveillance for one week.

Confiscated from Saberon’s possession were the P1,000 marked money used in the operation, P9,000 cash believed to be proceeds from his involvement in the drug trade, seven large packs and one medium sized pack of a white substance believed to be shabu.

The police also confiscated from Saberon 10 large packs of ‘brown shabu.’
