Trillanes 'waiting for a miracle' as another court decides non-bailable case

Metro Manila (CNN Philippines, September 25) — Senator Antonio Trillanes IV is holding on to a slim hope that another branch of the Makati Regional Trial Court would rule in his favor on his non-bailable case.

"As it is, milagro ang hinintay natin from Branch 148 (We are waiting for a miracle from Branch 148)," Trillanes told Senate reporters Tuesday.

"We're slightly more hopeful but we have to expect for the worst," the soldier-turned-lawmaker added.

Judge Bartolome Soriano of Branch 148 handled the coup d' etat case against Trillanes and dismissed it in 2011 "pursuant to the amnesty" granted by then President Benigno Aquino III.

Once Soriano orders Trillanes's arrest, the senator could no longer post bail, unlike what happened Tuesday when he paid P200, 000 for his temporary liberty on his rebellion case at Branch 150.

Judge Elmo Alameda of Branch 150 issued a warrant of arrest on Tuesday but set the bail at P200,000 - the same amount granted to Trillanes in 2010. He also barred Trillanes from leaving the country, as he granted a petition of the Justice Department.

Another arrest warrant next week?
It's now up to Soriano whether he would put Trillanes behind bars. While he has not set a date for resolving the case, the Rules of Court state that a judge has up to 30 days to do so.

Acting Prosecutor General Richard Fadullon told CNN Philippines they expect the resolution of Trillanes' coup case next week.

"There are still exchanges of pleadings that are going on," Fadullon said. He refused to comment on whether he thinks Soriano would also issue an arrest warrant against Trillanes.

The embattled senator, meanwhile, is back at the Senate as he and his lawyers decide on their next move.

He has been holed up there since September 4 when President Rodrigo Duterte's Proclamation No. 572, voiding his amnesty, was published on newspapers.

Alameda found "factual and legal bases" for the President's proclamation, thereby junking Trillanes' defense that he, indeed, applied for amnesty and complied with all the requirements, including admitting his guilt.

Trillanes, a former naval officer, was involved in the Oakwood mutiny in July 2003, the Marines standoff in February 2006, and the Manila Peninsula incident in 2007 - which were all against then President Gloria Macapagal-Arroyo.

Trillanes and fellow Magdalo soldiers were jailed but walked free when they were granted amnesty.

Trillanes dismayed, Roque happy
Trillanes expressed dismay over Alameda's decision, saying the judge was pressured by the Duterte government.

"Talagang nakakadismaya na itong ating hudikatura ay tumiklop sa pressure nitong diktador na si Mr. Duterte," Trillanes said.

[Translation: "I'm really dismayed that our judiciary gave in to the pressure of a dictator, Mr. Duterte."]

Meanwhile, Presidential Spokesperson Harry Roque told CNN Philippines he is "happy that Senator Trillanes is complying with the processes" when he went through booking procedure, and even had his mug shots taken at the Makati Police Station prior to posting bail.

Roque also said Trillanes' rebellion case should proceed, adding, "He will have his day in court."

Trillanes and his supporters claim the voidance of his amnesty was part of the government's crackdown against its staunch critics.

Malacañang has repeatedly denied going after those who oppose Duterte and his policies, even with the detention of Senator Leila de Lima, another strong critic of the administration. De Lima has said the drug charges against her were trumped up.

Metro Manila (CNN Philippines, September 27) — President Rodrigo Duterte seemed to have admitted his shortcoming on alleged extrajudicial killings (EJKs).

"Ano kasalanan ko? Nagnakaw ba ko diyan ni piso?... Ang kasalanan ko lang, yung mga extrajudicial killing," Duterte said in a speech during the recognition of career service professionals in Malacañang on Thursday.

[Translation: What is my sin? Did I steal even a peso? My only sin are extrajudicial killings.]

Local and international human rights groups have criticized the government's bloody war on drugs, which they said resulted in more than 13,000 EJKs. Government data show more than 4,000 were killed in anti-drug operations, but Malacañang has repeatedly said these were not state-sanctioned.

"Four thousand deaths. When? Where? How? What did they use?" Duterte said. He said ninja cops, or police officers involved in drug operations, may be responsible for these killings.

"They are the ones killing yung hindi ka makaremit sa kanila (those who can't remit to them). It's an organized crime actually," he said.

Duterte hits ICC, critics
Duterte again lashed out at the International Criminal Court (ICC) which is looking into alleged extrajudicial killings in the country.

"You are actually exercising functions that you are not supposed to do, (which) belongs to the government. At the very least, you are committing usurpation of authority," Duterte said.

Malacañang refused to cooperate with the ICC's preliminary examination, which will determine whether there is cause to go on a full-blown investigation.

Former Solicitor General Florin Hilbay in a tweet called on the ICC to take note of Duterte's latest pronouncement.

"Here's the President of the Republic of the Philippines, making a public admission of crimes under your jurisdiction. Please act asap," Hilbay said.

Duterte said even Jordanian King Abdullah II told him to ignore his cousin, United Nations High Commissioner Zeid Ra'ad Al Hussein, who has made public statements against the Duterte administration.

"Do not mind that brother… I don't even like him, he's a fake," Duterte recalled the king telling him. Duterte visited Jordan early September.

Al-Hussein earlier called Duterte out for ordering the police to ignore investigators of the country's drug war and even said the President should see a psychiatrist after the government asked a Manila court to declare over 600 people, including human rights advocates, as terrorists.

What are EJKs?
While there is no clear-cut definition of extrajudicial killings, Malacañang in October 2017 said it still follows the operational guidelines of Administrative Order No. 35, which created an inter-agency committee on extralegal killings in 2012.

Under this order, a killing is considered extrajudicial when "the victim was targeted and killed because of the actual or perceived membership, advocacy, or profession."

Then Justice Secretary Leila de Lima issued these guidelines in April 2013.

De Lima, now a senator fighting the Duterte administration and detained over drug charges, has filed a bill seeking to define and end extrajudicial killings.

Senate Bill 1197 defines extrajudicial killing as "the unlawful, and deliberate killing of targeted individuals or groups thereof, carried out by agents of the State and under its order or acquiescence in lieu of arrest, investigation and prosecution."

"Extrajudicial killing includes summary killings perpetrated by private individuals for purposes of carrying out on their own or in the context of vigilantism, a campaign or policy of the State," it further states.
