CHICAGO , Illinois – The American recording company that slapped Manny Pacquiao a $10-million lawsuit has withdrawn its complaint against the pound-for-pound king’s Emmanuel Pacquiao Foundation.

RBM Group International has sued Pacquiao in a breach of contract lawsuit before the Los Angeles Superior Court in California . (Read: Manny Pacquiao sued by record label for $10 million)

Based on court records, “partial dismissal without prejudice" against Emmanuel Pacquiao Foundation was filed by the lawyer of the “plaintiff/petitioner" on December 14, 2010.

Pacquiao hired Los Angeles-based law firm Hobson Dungog + Davis LLP.

GMANews.TV tried to get in touch with RGB Group lawyer Steven J. Cooper but calls were not answered.

RGB Group filed a breach of contract civil suit last November 17, 2010 against Emmanuel “Manny" Pacquiao and his Emmanuel Pacquiao Foundation, Carlito “Lito" Camo, and 10 other John Does, alleging that the eight division world champion reneged on his promise to “record the first two" of the contracted 12 songs “upon receipt of $40,000" on September 16, 2009.

The RGB Group, which counts Grammy Award winning producer and engineer Richard Segal Huredia as a member, agreed to pay Pacquiao $160,000 to record 12 songs.

Isaac Reain, producer/songwriter/engineer and artist; Ryan Dennison (president) producer/songwriter/engineer; Randy Sadd (head of radio promotion and top US promoter); head marketing/vice president and secretary, Gregorio Simbillo; MTV publicist Ginger Salaheih; Chief Operating Officer and LA Pinoy magazine publisher Rod Dasco; and Chief Executive Officer LA Pinoy magazine co-publisher Cecilia Lim are the members of the RGB Group International.

Attorney Marsha-laine F. Dungog, Pacquiao’s lawyer, said they are set to file a demurrer, which will be heard on March 23, 2011, before Judge Malcolm Mackey. A demurrer is a claim by the defendant (Pacquiao) that even if the allegations in a complaint are true, they are not sufficient to impose any liability on the defendant.

Brother... to have a legal case in USA is not a laughing matter, most especially if it is worth more than $10 million dollars.

to my fellow paclanders,

die_hard is cool now. before, he posts an article by piecemeal - one paragraph per reply. then, posts the same article in virtually all of his threads. now, he is just a good source of news as he posts every thread that he finds on the web. of course, he replies to almost all of the comments of his threads, which should be the case in forum. the purpose of a thread is discussion, isn't it? some are just annoyed with his style/signature.

GMA-7 News yesterday reported that the RBM Group International filed the case in Los Angeles due to Pacquiao’s alleged failure to record the first two songs of a 12-song contract upon his receipt of $40,000 on Sept. 16, 2009.
Pacquiao was to get $160,000 to record the 12 songs. GMA-7 also reported that Marshalaine F. Dungog, Pacquiao’s lawyer, would file a demurrer, to be heard on March 23, 2011. A demurrer is a move that even if the allegations in a certain complaint are found to be true they are not sufficient to impose any liability on the defendant. An American-Mexican promoter also filed a $1.8 million case against Pacquiao last November due to the latter’s alleged failure to appear in a promotional gig last September.
The Texas court then ordered that $1.5 million of the boxer’s income for his fight against Antonio Margarito be held back until the case is on. Edmundo Lozano, the promoter, said Pacquiao entered into a $100,000 contract with his outfit for a social appearance in McAllen Texas. But it never pushed through because the boxer was busy training for the Nov. 13 fight with Antonio Margarito. “Our lawyers are taking care of it,” Pacquiao said after the case was filed.
