'Fakes' pulled out from Greenhills stalls

MANILA, Philippines -- The Greenhills Shopping Center (GSC) has ordered its tenants to stop selling counterfeit versions of 23 well-known brands or risk being charged with breach of contract and reported to the National Committee on Intellectual Property Rights.

According to Chester Arturo Cinco, head of the secretariat on IP inter-agency coordination at the Intellectual Property Office of the Philippines (IPOPHL), 23 brand owners had submitted affidavits to the agency, as of Dec. 21, 2010, signifying their intent to be more vigilant in protecting their brands.

Counterfeited products carrying six brands were pulled out from GSC stalls as early as Dec. 14, 2010, as a result of a letter of request that IPOPHL director general Ricardo Blancaflor sent to GSC administrator Catherine Ko. The counterfeited labels were Louis Vuitton, Gucci, Sanuk, Fitflop, Nike, and Breitling.

Another 17 brand owners submitted separate affidavits to IPOPHL a week later, prompting the agency to write Ko another letter with the same request to pull pirated versions of these goods out of GSC stalls.

The 17 brands that complained were Lacoste, Levi's, Oakley, Puma, Chloe, Dunhill, Lancel, Bulagri, A. Lange & Sohne, Cartier, Montblanc, Panerai, Baume & Mercier, IWC, Jaeger-Le Coultre, Piaget, and Vacheron Constantin.

Cinco said both IPOPHL and the brand owners themselves were conducting monitoring activities at the GSC to ensure that counterfeit versions of the 23 brands would no longer be sold in the commercial center.

Brand owners provided regular monitoring reports to IPOPHL, he said.

"If we receive reports that counterfeits are on display, we inform GSC,'' he said in an interview with the Philippine Daily Inquirer. "For example, on Dec. 20, 2010, we wrote a letter to GSC informing them of the reports we received from monitoring teams, particularly the report that selling of counterfeits are done secretly.''

Stores that would be caught selling items on the IPOPHL list would be stripped of their lease contracts in specific commercial centers. Violators would also be charged with breach of contract with the shopping center as one of the standard conditions in rental contracts was a ban on selling counterfeit products or replicas of well-known brands.

Cinco said IPOPHL also requested a stall at the GSC, which would serve as a satellite office, to enhance monitoring efforts at the shopping center.

IPOPHL also sent a similar letter to the management of the 168 Shopping Mall in Manila last month, but had yet to get a response, he related.
